Intra-Company Transfer of Employees to EU Countries (Intra Company Transferee)
The legislation in 25 EU countries, the UK, and the USA provides a simplified procedure for obtaining a residence permit through the Intra Company Transferee (ICT) program.
Intra Company Transfers (ICT) are issued for transferring management and key employees from the parent company to its branch in one of the EU countries.
In other words, if your company’s headquarters is located in Ukraine, Belarus, the USA, or other non-EU countries, but you or your top employees need to stay for business purposes for more than 3 months in countries like Germany, Spain, the Netherlands, or Italy, you can register a branch and apply for this type of visa.
Conditions and Requirements for Intra-Company Transfer and Employment at Your Branch in the EU:
The parent company must remain operational for the entire duration of employment at the EU branch.
It is necessary to prove that the EU branch and the parent company belong to the same group of enterprises.
The employee must have worked for the company abroad for at least 12 continuous months. This period may vary depending on the company’s situation, such as how long the parent company has been operating and its business success.
The intra-company transfer is for a period of more than 90 days.
Proof that the third-country national possesses the professional qualifications and experience required at the EU branch.
The salary must be at least the average level for the professional profile in the country where the branch is located.
